that movie theater shooting in aurora, colorado. the latest find from his apartment, after they finished clearing out his home of all of the booby traps and ammunition they found a batman mask. they learned the former university of colorado neuroscience graduate student began buying guns almost two months ago. he did so legally in person and online, also purchasing 6,000 rounds of ammunition. some of these weapons he used during friday morning's mass shooting that turned the premier into an historic massacre. holmes is currently in solitary confinement at a county detention facility where he is not cooperating. he has been assigned a public defender. he will be advised of his rights and the judge is expected to set a date for the formal filing of charges. he is expected to face at least 70 charges, one for every person he shot and he could face

additional counts of aggravated assault and weapons violations. holmes' first court appearance part of what could take months. >> we will convict. yes. >> a big issue is whether the prosecutor will seek the death penalty. the defense will likely argue whether holmes is mentally competent. his legal team is expected to go inside the century 16 movie theater today to look at what's left to help put together a defense. holmes is expected in court at 8:30 this morning. >> so many watching that. grief, anguish, anger for friends and family of the 12 people killed at that theater. this morning we're getting a first look at some of those whose lives were taken far too soon. many of the victims died as they saved others. matt quinn took a bullet shielding his girlfriend and her

brother. alexander teves pushed his girlfriend out of the way. jesse childress died trying to save a female air force. >> what a great hero he is. and like he provided me the opportunity to survive. >> jessica ghawi was a sports reporter. rebecca wingo was a working mom pursuing a degree. 27-year-old john thomas larimer was a petty officer in the navy. >> he was an outstanding ship mate, a valued member of our navy team. extremely dedicated sailor. >> 51-year-old gordon cowden was a devoted father. alex sullivan's one-year wedding

anniversary was yesterday. and alexander boik was engaged to his girlfriend. the youngest victim is veronica moser. her mother was told last night she'd never see the 6-year-old who loved to read and play dress-up. >> beyond heart breaking and tragic. in the city of aurora president obama meeting with the victims' families offering words of comfort to a community shaken by the tragedy. >> the task was to serve as a representative of the entire country and let them know that we are thinking about them at this moment and will continue to think about them each and every day. >> shattering, it has shaped the national agenda at least for the moment. the president and republican challenger mitt romney put their campaigns on hold over the weekend out of respect for the victims and survivors.

at a san francisco fund-raiser last night romney said he was planning to tone down his message and join president obama in supporting the people of aurora. in all, romney headlined bay area's three events sunday all hosted by hewlett-packard ceo meg whitman. >> hours after romney theft bay area president obama arrived and is getting rest before another whirl wind campaign visit. we have team coverage. mike tells us house the visit could affect your commute. first, "today in the bay's" christie smith live at the fairmont hotel where the president is waking up this morning. good morning, ristie. >> reporter: good morning to you. president obama has visited the bay area several times on the campaign trail, usually here in san francisco as you said where he is waking up this morning or in silicon valley. this time he's going to be visiting the east bay after arriving at sfo last night around 8:15. and giving a quick wave to the crowd.

he was initially expected to arrive today but there was a slight change of plans after he visited with families in aurora, colorado affected by the tragedy there. he has three east bay fund-raisers today. before that he'll head to reno to speak with the veterans of foreign wars. he returns to oakland where he is likely to be met with some protesters including anti-war protesters, and those upset with recent crackdowns on medical marijuana dispensaries in oakland. those demonstrating are expected to be at his big event at the fox theater later on today. president obama was just in san francisco in early june for only four hours and during that time he raised about $2 million, from there it's off to portland and of course with all of these travels in the east bay, your traffic is bound to be affected. for more how to get around it i'll turn it over to mike. >> you talked about three separate events in oakland.

the president has to travel around town in addition to getting back from the airport. the president is going to be in the bay area from reno later this afternoon. when he arrives at oakland we'll have to have road closures for security. that also means changes for b.a.r.t. police are closing several streets from 10:00 this morning possibly to 10:00 tonight for that visit. includes parts of telegraph, 17th street, 18th and 19th street where they meet with san pablo. san pablo and broadway are affected by closures. listen to this b.a.r.t. riders. the 17th street entrance to the 19th street b.a.r.t. station will be closed. riding through the area, important, the station will remain open for the morning. it's just that one entrance, 17th street, that will be closed because of security reasons. in addition to the streets listed we have oakland police department telling us general traffic interruptions as the president travels from downtown to oakland. they will do motorcades. this will affect ac transit

through the area and uptown oakland so keep that in mind as you ride the bus this morning. you'll have to have some reroutes. back to you. >> thanks for the update. dozens of people out of their home this is morning after a fire guts part of a san jose apartment building. 20 units at the apartments on camden avenue were damaged. the fire sparking at 9:30. it took more than 70 firefighters to get it under control. 5 people were treated. a total of 60 people displaced. >> cooler this morning. that could be windy in the south bay. want to check in with meteorologist christina loren. >> good morning, jon and laura a. good looking day. temperatures are in the 50s to start and we're headed to the 90s so it's not going to be as warm as yesterday but it is crisp out there. if you have outdoor activities you want to get taken care of, the earlier the better off in livermore our hottest city. 93 there. 57 in san jose. we're headed toward probably the

ways to get around some of the presidential traffic issues. let you know how to beat it. >> new evidence indicates it's never too soon to battle early childhood obesity. a government panel is recommending kids as young as 9 be screened for high cholesterol. in some cases cholesterol fighting drugs are even recommended. there is debate among doctors whether the drugs could put children at additional risk. some of the drugs have been linked with a rare muscle disorder. >> canadian scientists celebrate what is called a breakthrough in cancer research. researchers at the ottawa hospital research institute are working on what they call a personalized vaccine. here is the deal. the vaccine would use your own body to fight off cancer instead of toxic drugs. it would mix the patient's tumor with the virus that targets and kills cancer cells. together that alerts the immune

nasdaq. sender withdrew saying the market conditions weren't right. that appears to have been a mistake. laura mentioned the broader markets are unhappy. mostly over europe. kayla tausche is live with that. good morning. >> good morning, scott. futures unfortunately pointing to a negative stock market open, that's following friday's launches as eurozone fears spook investors. stocks in asia and europe getting hammered on worries about spain and concerns that greece may not get further aid. we'll get earnings from mcdonald's and texas instruments. the dow closed 1% lower friday to 12,823, and the nasdaq lost 1.4% to 2925. a setback for kodak after losing a key patent lawsuit. at issue is its digital image preview technology which could dak argues is used by modern

so, it all works out like this. you see all of that moisture. that's monsoonal moisture wrapping around high pressure. for us we're going to see another round of mountain thunderstorms and the clouds building and bubbling up over the western facing slopes of the south bay. so get ready for that. the highs today not too shabby. i'm forecasting about 85 degrees in san jose. 93 in almost. 90 in fairfield. we drop off as we head throughout the upcoming weekend. let's check your drive. >> we'll take you out to the east bay. we're looking at the area around hercules off interstate 80 and 4. it's off of the freeway. san pablo avenue at willow avenue. might be concern for folks coming through rodeo. the traffic flow on the area past the accident is moving for interstate 80 past highway 4 down toward the bay bridge. 18 minutes from the carquinez bridge to the toll plaza in the corner. here i'm circling, told you about the road closures affecting folks into the area.

good ways around the slowdown, you're going to take ac transit or b.a.r.t. b.a.r.t. takes you through downtown, no service interruption. those are open except for the 17th street entrance. a live look across the bay. we're looking at the san mateo bridge. a nice flow from the peninsula side. that's eastbound. westbound, that's your commute direction and a steady flow but no problems. 880 side or on the peninsula side. let's follow up with 101 on lower bay shore, where we're moving across the dumbarton bridge. coming down through the area through palo alto, embarcadero to university, you are down to one lane in both directions. construction continues overnight. we should be clear by 6:00 a.m. we don't see slowing because of that light volume flew the peninsula. allow a couple of minutes. a smooth drive northbound through san jose, and no closures for crews, that's great for traffic. back to you. >> thank you. it's 5:19. a decision over leash laws on

federal parklands is delayed. the national park service says it could take two more years before they issue rulings. they want to use the time to go over the suggestions from dog owners. the original plan called for all dogs to be leashed in open spaces like golden gate national recreation area. the park service says it's a safety issue but dog owners say dogs need somewhere to run free. don't they. another dog-related issue, a controversial hunting practice could soon be banned. the state assembly is considering a bill which would prohibit the use of dogs during hunts. backers of the measure says the practice is cruel and leads to mistreatment. a vote is expected in a few weeks. >> coming up, a police officer, will a police officer's mistake keep an oakland raider from a criminal conviction. >> sun coming up over the south bay. looking live over san jose this morning.

>> welcome back everyone. we're waiting for the n. a live look outside. south san francisco. 5:23. >> new developments in the dui case against an oakland raider who goes by the name of darrius heyward-bey. his lawyer will appear 18 courtroom. police may have made a procedural mistake that led to his arrest. bay is accused of driving under the influence after being pulled over on the bay bridge on april 7. >> katherine jackson, mother of the late superstar michael jackson, is safe this morning two days after she was reported missing. the report was filed saturday after jackson's grandchildren say they had not been able to reach her for more than a week. authorities said they made contact with jackson and jermaine jackson released a

roads. we have the presidential visit we talk about that for both sides of the bay. far east bay, the issue starting to heat up for the volume off of the antioch bridge so a little unusual slowing approaching hill crest. once you head over to a you're okay with the 50s starting to dip now before 5:30. a nice easy drive, walnut creek, 580 starts the slowing, coming through livermore westbound 580 is your commute direction, and there is the slowing, the 40s where you see the yellow. okay toward the dublin interchange. in the north bay as well, not a big deal. the taillights, good number of southbound to south of the curve heading to lincoln avenue. north bay shows at the limit, novato in toward san francisco. back to you. >> thank you. it's 5:25. opening day of the new batman film was marred by the shootings in colorado early reports show the film was still on track to set a record for sales.

>> it's almost 5:30. good morning. thanks for joining us. i'm jon kelley. >> i'm laura garcia-cannon. after the massacre president obama arrived in the bay area for another fundraising trip. we have team coverage. mike inouye tells us how the presidential visit could affect your morning commute. first, christie smith live at the fairmont hotel where the president is waking up this morning. good morning, christie. >> reporter: good morning to you, laura. this is very familiar territory for president obama, that is waking up in san francisco. of course he has been here many times for fund-raisers along the peninsula, silicon valley. this is a first, he's going to hold fund-raisers in the east bay. he will be in oakland, that after touching down last night around 8:15 at sfo. the plans were changed originally he was expected to arrive today but the president

visited families affected by the tragedy in aurora, colorado. this morning before he gets started in oakland he is going to make a stop in reno, then come back, in the east bay he has three fund-raisers, the one at the fox theater expected to draw big crowds. protesters including medical marijuana advocates that are upset with federal crackdowns happening in oakland. also anti- -- that could have an unintended effect of helping the president with conservatives. he was just here if you recall in early june for a quick fund-raiser in san francisco where he raised an estimated $2 million in a few hours. because of all of this going on in oakland, the police department has put out an advisory for motorists. you'll want to adjust your schedules because the motorcade is going to go through there and for more on that i'll turn it over to mike. >> good morning.

the president swinging back into the bay area this afternoon. you're talking about him coming back to oakland. so there are going to be road closures and changes to b.a.r.t. first, look at the road closures. starting at 10:00 this morning includes parts of telegraph avenue, 17th, 18th, 19th street. basically the portion of those between san pablo and telegraph, might affect broadway as well. let's get a live look at the streets now. our photographer is near the fox theater, one of the proposed sites for the visit. also the b.a.r.t. stations will be open in the area but the 17th street entrance to the 19th street will be closed for security reasons. the one entrance and the reroute through downtown, also parts of piedmont. there will be delays and you'll get around them but you'll have to slow a tad if you're on mass transit as well. >> thank you.

a brilliant student turned accused and twisted mass murderer will appear in court. first-degree murder charges will be read against 24-year-old james holmes in colorado's courtroom. the student accused of killing 12 people, injuring 58 others on friday. in minutes, we'll go in depth with a criminal psychologist about the suspect, his behavior and why he is refusing to cooperate with police. >> a 5-year-old girl shot in the neck on her way to get ice cream. now a reward is offered to track down the person. police say the little girl was hit by gunfire along 50th avenue saturday while walking past a fire station with her family. officers say the girl was not the intended target. she's still in the hospital in stable condition. a $5,000 reward is available to any one who shares information that leads to an arrest and conviction. >> bryan stow will get his day

in court a judge setting a february 5th trial date. stow is suing the dodger owner for a beating outside of dodger stadium during last year's opener. the court papers say he suffered permanent brain damage. his lawyer says he needs life long care. the two men have pleaded not guilty criminal charges. >> bay area police departmentsen alert over suspicious mail. oakland pd was the latest to receive the envelope with white powder. the substance turned out to be harmless but other departments have also received similar mail last week. also harmless. the fbi is helping in the investigation. >> this morning two prominent neurosurgeons at uc davis accused of experimenting on dying brain cancer patients. they say they did have the patients' permission.

they believe they would have prolonged their lives. all three patients later died. they are now being banned from performing medical research on humans. no word if investigations will follow. >> a conviction is not stopping mary highoshy running for office. she plans to run for a seat on the alameda county board of supervisors. she remains on probation after snatching $2500 in clothing from a neiman-marcus store in october. at the time her lawyer claims a brain tumor affected her decision-making. she says she was distracted by a phone call and forgot to pay for the merchandise. >> the college students working for state will lose their jobs 18 cost cutting move. 1600 positions will be axed come september. the student who is work mostly part-time job without benefits in jobs from desk work to field

as we give you a nice shot of that sun rising out on the horizon. a beautiful week ahead. enjoy. 5:39. >> the penn state football team's golden image is now tarnished in the wake of a sex abuse scandal. >> in minutes we'll be finding out how the ncaa plans to crack down against the university. chris pollone is live in indianapolis and chris, we expect some heavy blows against a very storied program this morning and it's not going to be pretty. >> reporter: jon, they are using words like unprecedented and severe in terms of the penalties that penn state could face, like you said we're going to find out in about 20 minutes now what penn state faces for its role in the jerry sandusky scandal. of course the louis freeh report came out about ten days ago detailing what the leaders of penn state including coach joe paterno did or didn't do with regard to reporting sandusky when it became known he was

accused of molesting children over the last 10, 12 years or so. now, over the last 24 hours we've started to learn from people who are familiar with what's going to happen here today, what penn state could possibly state. we're hearing things like 30 to $60 million in fines, which would be used to set up an endowed fund to help the victims, the young victims of child sexual abuse. we're hearing that on the football field they could face a scholarship reduction, possibly as many as ten scholarships taken away for a certain number of years which would affect penn state's ability to compete on the field as well as a postseason ban preventing them from going to championship games or bowl games for a set number of years. of course, that's what people who are familiar with this punishment are saying what really comes down in the final moments in about 20 minutes from now, will have a lot more and we'll figure it out. obviously it's a big day and unprecedented day in terms of the ncaa and for penn state

university. >> chris, thank you for the update on that. former chicago area police officer accused of killing his third wife and suspected in the disappearance of his fourth will return to the national spotlight today. the the jury selection starting today in the drew peterson murder trial. peterson charged with drowning his third wife in 2004 and the death was originally declared an accident. peterson was later charged after his fourtd wife disappeared three years later in 2007. peterson has been locked up for the last three years awaiting trial. >> at least 11 people are dead, another 12 injured after a pickup truck loaded with passengers crashed in texas. this happened about 100 miles south of san antonio. investigators say it appears the truck blew a tire, then slammed into a tree. 23 people were just crammed in the truck's cabin and bed. >> new details about the 24-year-old man accused of

turning the premier of the latest batman movie into a movie massacre. james holmes is expected in a courtroom to make his first appearance since his friday morning arrest. first greg murder charges will be read and a judge is expected to set a date for the formal filing of charges. the doctoral student is accused of killing 12 people, injuring 58 others during a shooting spree at a century 16 in aurora, colorado. the story gripping the nation including our own president who met privately with the families of the victims. >> the main task was to serve as a representative of the entire country and let them know that we are thinking about them at this moment and will continue to think about them each and every day. >> more than 10,000 people gathered for a vigil to honor the victims on sunday. holmes is expected in court at 8:30 this morning. >> as all of this continues to

sink in that senseless and deadly massacre left all of us asking why would anybody do this? why would someone want to kill so many innocent people? marla tellez joins us with somebody who may help explain this senseless tragedy. >> jon, good morning drxt gray assistanceier is a retired police officer who is now a forensics expert, psychology instructor and become known as a police psychologist. he studies criminal minds and we're lucky enough to have him with us. thank you for being with us. >> good morning. >> in a case like this we hate to give attention to the shooter, still having all of us dumfounded. many of us surprised that james holmes is deemed a brilliant student. how does his alleged genius play into his role here? >> it's a typically complicated issue. if you start looking at the trends that developed he was a successful graduate student, undergrad, then graduate school but suddenly dropped out. that's when you look at the trend where why did he start to drop out. i know that the call was made to

his mother and she said something similar to you have the right person, so certainly we don't have enough information yet but i'm thinking that perhaps he had early onset schizophrenia because he started to demonstrate behaviors consistent with something like that disorder. >> and specifically you talk about demonstrating such behavior, what specifically are you referring to? >> well, his behavior, he got to the movie theater and was aligning with the joker, and then i think one of the most recent situations was they found a poster in his room. so something happens many times with people with developing schizophrenia is called command hallucinations, they perceive someone is giving them orders to proceed and it could have been he might have perceived that batman was telling him to conduct these behaviors and act out like he did. i know it's hard for people to understand but what can happen when someone decompensates so quickly. in his case it could be consistent with schizophrenia. >> looking at the case now from

your perspective, a retired police officer, he is in solitary confinement, not cooperating with authorities. how do you pursue the case? >> certainly it's very difficult. we hope that perhaps his parents, i know that they are there with him now. one of the issues that many times occurs is that people with these disorders are incredibly bright almost to the point of being geniuses. the issues at hand now are he may have decided to not say anything because of counsel that arrived and said don't comment. the problem is one of he's incredibly bright and may want to tell his story. when you have hallucinations and delusions you can't decide when you're mentally ill or not. a lot of people don't understand, when we find out more about his background and why he started to decompensate we'll learn more because he may be found to be guilty by reason of insanity and that will probably be his defense at some point. >> thank you so much for your

smooth down to the bay bridge. the east shore freeway, 18 minutes. approaching the toll plaza no big deal there. downtown oakland we continue to talk about the closures and delays because of president obama's visit. a smooth flow. a live look at the coliseum, see the volume pretty light. if you get off at 16th you have an igloo water cooler being cleared. should be clear soon. further south, san jose, we look here, 880 over to 17 to the santa cruz summit. a smooth drive. 280 northbound shows an increase as far as the volume but no major slowing throughout the south bay. smooth up the peninsula as well. 101 all across the golden gate bridge. look at that, no problems here. a smooth drive. and visibility is great across the span. low clouds hover but no problems for drivers.

good morning to you. it's a give and take with all of the micro climates, the best weather bay side and at the coast. 77 degrees by the bay at noon. up to 82 in the heat of the day, at the coast in the 70s so great beach weather if you want to work on your tan. a major cooldown on the way. i'll detail that coming up in my next report. 5:55. it's monday, summertime, yet smik busy. let's check in with him. >> it's almost 6:00. good morning. so as we approach 6:00 we see a lot of slowing, specifically for highway 4 in antioch. i think it's the second worst. we have westbound into livermore out of the altamont slowing as well as through central livermore. circles around north first and livermore and here again for the dublin interchange. a good volume of traffic slows all the way along this stretch. that's pretty good.
